Early Departure

UT Health San Antonio is required to report to the U.S. Department of Labor (DOL) and U.S. Citizenship and Immigration Services (USCIS) early employment end dates of any H-1B employee. An Early Departure Form must be completed within 10 days of employment termination and returned to OIS.

Termination

If the department terminates the H-1B employee’s employment for any reason, including for lack of funding or performance issues, prior to the validity end date of the approved H-1B petition, the department MUST offer the cost of reasonable return airfare to the employee’s last place of foreign residence. If the employee chooses to leave the U.S. and does not apply for a new immigration benefit, the department will provide one non-refundable, non-transferable, one-way ticket for return travel to the employee’s last place of foreign residence. This does not include the cost of the return airfare for H-4 family members or for the employee’s personal property.

Voluntary Departure

If the employee ends the employment relationship, or if the employee remains in the U.S. to work for another employer or apply for another immigration status, the University is not under this obligation.  If you have any questions, contact your International Services Representative.
