These changes may affect J-1 exchange visitors who need additional time to complete their programs.<\/p>\n<p>Departments, faculty sponsors, and exchange visitors are encouraged to review their program end dates and plan in advance if an extension may be necessary.<\/p>\n<p><strong>Duration of Status (D\/S):<\/strong><br \/>\nWhen a nonimmigrant enters the United States, a U.S. Customs and Border Protection (CBP) officer determines how long the individual is authorized to stay in the United States. This information is recorded on the individual\u2019s Form I-94.<\/p>\n<p>For Graduate Medical Education (GME) participants, the J-1 sponsorship is renewed annually through Intealth, with sponsorship available for up to 7 years. Annually, the SEVIS record is updated and a new Form DS-2019 is issued to reflect the continued period of sponsorship. Therefore, ECFMG-sponsored individuals admitted for D\/S could generally remain in the United States as long as they continued to meet the requirements of the J-1 status.<\/p>\n<p>For ECFMG J-1 physicians, this generally meant:<\/p>\n<ul>\n<li>Continuing to participate in the approved J-1 program;<\/li>\n<li>Maintaining a valid SEVIS record;<\/li>\n<li>Following the requirements of J-1 status; and<\/li>\n<li>Completing the program within the authorized program period listed on the DS-2019 that ECFMG issues.<\/li>\n<\/ul>\n<p>It is important to understand that the I-94 and visa serve different purposes. The visa allows an individual to request entry to the United States, while the I-94 shows how long the individual is authorized to remain in the United States after entering.<\/p>\n<p><strong>Admit Until Date (AUD):<\/strong><br \/>\nThe Admit Until Date (AUD) is the date on your Form I-94 that indicates when your authorized stay in the United States ends. Beginning September 15, 2026, J-1 scholars and their dependents will be admitted for a specific period, with an end date listed on their Form I-94. The AUD should include the applicable grace period following the completion of your program.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-3489\" src=\"https:\/\/wp.uthscsa.edu\/ois\/wp-content\/uploads\/sites\/40\/2026\/08\/D-S-I-94-Sample-550x298.png\" alt=\"Sample of I-94 Travel Record\" width=\"550\" height=\"298\" srcset=\"https:\/\/wp.uthscsa.edu\/ois\/wp-content\/uploads\/sites\/40\/2026\/08\/D-S-I-94-Sample-550x298.png 550w, https:\/\/wp.uthscsa.edu\/ois\/wp-content\/uploads\/sites\/40\/2026\/08\/D-S-I-94-Sample-800x433.png 800w, https:\/\/wp.uthscsa.edu\/ois\/wp-content\/uploads\/sites\/40\/2026\/08\/D-S-I-94-Sample-768x416.png 768w, https:\/\/wp.uthscsa.edu\/ois\/wp-content\/uploads\/sites\/40\/2026\/08\/D-S-I-94-Sample.png 1024w\" sizes=\"auto, (max-width: 550px) 100vw, 550px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Extension of Stay (EOS):<\/strong><br \/>\nAn application submitted through <a href=\"https:\/\/www.uscis.gov\/i-539\" target=\"_blank\" rel=\"noopener\">Form I-539<\/a> to United States Citizenship and Immigration Services (USCIS) to obtain an additional period of authorized stay beyond the approved AUD.<\/p>\n<p><strong>Changes Under the New Rule, effective September 15, 2026<\/strong><\/p>\n<ul>\n<li>Have a specific expiration date on their Form I-94 rather than the \u201cD\/S\u201d notation.<\/li>\n<li>J-1 physicians will be admitted for a specific period of stay with a set end date, generally based on the residency or fellowship end date recorded in SEVIS plus a 30-day grace period. The initial period of admission will generally be limited to four years or the end of the training program, whichever comes first.<\/li>\n<li>Be responsible for checking their Form I-94 and keeping track of their authorized stay.<\/li>\n<li>Need to take additional steps if they need to remain in the United States beyond the I-94 expiration date. For J-1 physicians, this may include first requesting an extension of J-1 sponsorship through ECFMG\/Intealth and obtaining an updated Form DS-2019. The physician may then need to file an Extension of Stay (EOS) application with USCIS before the I-94 expires, or travel outside the United States and seek readmission for a new period of authorized stay.<br \/>\nNote: Extension can be filed with USCIS up to 180 days prior to the experation fixed date on the I-94.<\/li>\n<\/ul>\n<p><strong>What Intealth Is Doing?<\/strong><br \/>\nAccording to ECFMG\/Intealth, J-1 physicians may see changes to how their DS-2019 forms are issued as the new admission rules take effect. Instead of receiving a new DS-2019 each year, physicians may receive a multi-year DS-2019 covering the full approved training period. This is intended to better align the DS-2019 dates with the physician\u2019s training program and provide greater predictability for physicians and training programs.<\/p>\n<p><strong>Important: <\/strong>The multi-year DS-2019 does not eliminate the requirement for physicians to complete their annual J-1 sponsorship renewal with Intealth.<\/p>\n<p><strong>Four Years Is Not a Maximum Time in J-1 Status:<\/strong><br \/>\nA common confusion about the new rule as related for the J-1 Research Scholar category is that J-1 scholars will only be allowed to remain in the United States for a total of four years.\u00a0This is not correct.<\/p>\n<p>The four-year period generally refers to the maximum length of a single period of admission, not the total amount of time an individual may participate in a J-1 program in the United States.<\/p>\n<h3>Frequently Asked Questions<\/h3>\n<p><strong>How does the new rule impact J-1 Physicians and Training Programs<br \/>\n<\/strong>The full implementation of the new rule is still developing, and additional guidance from federal agencies may provide more details. The changes are likely to be most important when a physician\u2019s current period of admission is ending, particularly when:<\/p>\n<ul>\n<li>Moving from one training program to another;<\/li>\n<li>Continuing training beyond the initial I-94 end date; or<\/li>\n<li>Approaching the four-year admission period.<\/li>\n<\/ul>\n<p>In these circumstances, Intealth sponsorship and SEVIS updates alone may no longer be sufficient. Physicians may also need to work with their programs and USCIS to obtain an additional period of authorized stay by filing the <a href=\"https:\/\/www.uscis.gov\/i-539\" target=\"_blank\" rel=\"noopener\">Form I-539.<\/a> This mean additional paperwork and fees, earlier planning, and coordination among the physician, training program, Intealth, USCIS, and CBP.<\/p>\n<p><strong>Important: J-1 Physicians should check their Form I-94 after entering the United States and keep track of their AUD.<\/strong><\/p>\n<p><strong>What if I am already in the United States before September 15, 2026?<br \/>\n<\/strong><span style=\"font-size: inherit\">If you are already in the United States in J-1 status and were admitted under Duration of Status (D\/S) before September 15, 2026, the new rule generally will not change your status immediately.<\/span><\/p>\n<p>For J-1 physicians, ECFMG\/Intealth may issue an updated, multi-year Form DS-2019 reflecting the approved residency or fellowship training period. If additional training time is needed, physicians should work with their program and ECFMG\/Intealth to obtain the appropriate sponsorship extension and an updated DS-2019 before their current program end date.<\/p>\n<p><strong>Important for travel:<\/strong> If you travel outside the United States after September 15, 2026, your admission will be subject to the new rules when you return. CBP will generally issue an Admit Until Date (AUD) based on the applicable program end date shown on your DS-2019, along with the applicable 30-day grace period.<\/p>\n<p>Plan ahead: If you have international travel planned after September 15, review your DS-2019, visa, and anticipated I-94 end date with your program and OIS, and ECFMG\/Intealth before traveling.<\/p>\n<p><strong>What if my passport expires before my program ends?<br \/>\n<\/strong>Your passport should generally be valid for at least six months beyond the date you plan to enter the United States, unless your country is covered by an exception to the six-month passport validity rule. If your passport expires before the end of your program, your authorized period of admission may be limited by your passport expiration date. This could result in an I-94 end date that is earlier than your program end date.<\/p>\n<p>To avoid travel or status complications, renew your passport well in advance of its expiration date, especially if you plan to travel internationally.<\/p>\n<p><strong>How does the new rule affect my J-2 dependents?<br \/>\n<\/strong>The new rule also applies to J-2 dependents who enter the United States on or after September 15, 2026. If the J-2 is currently in the U.S., were admitted under Duration of Status (D\/S) before September 15, 2026, the new rule generally will not change your status immediately on that date. If the J-2 remains in the United States without requesting an Extension of Stay (EOS) or travelling outside the U.S., the new rule generally will not change your status immediately on that date.<strong><br \/>\n<\/strong><\/p>\n<p><strong>Are there any changes to the USCIS Forms I-539 for Extension of Stay and I-765 Employment Authorization?<\/strong><br \/>\nYes. USCIS will release revised editions of Forms I-539 and I-765 on September 15, 2026, in connection with the new rules establishing a fixed period of admission, an Admit Until Date (AUD) on Form I-94. There will be\u00a0no grace period\u00a0for the new editions. Applicants filing on or after September 15 must use the 09\/15\/26 editions.<\/p>\n<ul>\n<li><strong>Form I-539: Application to Extend\/Change Nonimmigrant Status<\/strong><br \/>\n\u2013 USCIS will accept the 08\/28\/24 edition if it is filed before September 15, 2026.<br \/>\n\u2013 USCIS will accept the 09\/15\/26 edition beginning September 15, 2026.<br \/>\n\u2013 The older 08\/28\/24 edition will not be accepted if filed on or after September 15, 2026.<\/li>\n<li><strong>Form I-765: Application for Employment Authorization<\/strong><br \/>\n\u2013 USCIS will accept the 08\/21\/25 edition if it is filed before September 15, 2026.<br \/>\n\u2013 USCIS will accept the 09\/15\/26 edition beginning September 15, 2026.<br \/>\n\u2013 The older 08\/21\/25 edition will not be accepted if filed on or after September 15, 2026.<\/li>\n<\/ul>\n<p><strong>Important:<\/strong> Do not submit the 09\/15\/26 editions before September 15, 2026.
