{"id":3619,"date":"2026-09-15T13:36:04","date_gmt":"2026-09-15T18:36:04","guid":{"rendered":"https:\/\/wp.uthscsa.edu\/ois\/?p=3619"},"modified":"2026-09-15T15:27:20","modified_gmt":"2026-09-15T20:27:20","slug":"proposed-rule-to-eliminate-the-60-day-discretionary-grace-period","status":"publish","type":"post","link":"https:\/\/wp.uthscsa.edu\/ois\/2026\/09\/15\/proposed-rule-to-eliminate-the-60-day-discretionary-grace-period\/","title":{"rendered":"Proposed Rule to Eliminate the 60-day Discretionary Grace Period"},"content":{"rendered":"<p>On September 11, 2026, the Department of Homeland Security (DHS) has published a proposed rule titled \u201c<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2026-09-11\/pdf\/2026-18631.pdf\" target=\"_blank\" rel=\"noopener\">Eliminating the Discretionary 60-Day Grace Period<\/a>.\u201d This proposed rule would remove the discretionary grace period of up to 60 days following the employment separation that occurs prior to the individual\u2019s approved period of immigration status. Those employment visa categories, such as E\u20131, E\u20132, E\u20133, H\u20131B, H\u20131B1, L\u20131, O\u20131, or TN are affected by this proposal.<\/p>\n<p>At present, the discretionary grace period is still active and available.
