Potential Government Shutdown and the Impact on Immigration at UTHSA

If you have not been keeping up with the U.S. news recently, there is a potential government shutdown that may go into effect on October 1, 2023 if Congress is unable find common ground on a budget. So, what does this mean for our international students, scholars, and faculty members and to our hosting/hiring units at UTHSA?

  • U.S. Citizenship and Immigration Services (USCIS): USCIS is driven by fees. They will continue to process any H-1B petitions that are filed so long as the petition includes a certified labor condition application from the Department of Labor. Any F-1 student requesting work authorization may continue to submit their I-765 application to USCIS.
  • Customs and Border Protection (CBP): No impact to most of our sponsored international community. For those that hold TN status, would need to check the operational status of their location that they will apply for their benefit.
  • Department of Labor (DOL): The ability for OIS to file labor condition applications for H-1Bs would be impacted as the DOL’s system will unfunctional.
  • Department of State (DOS): There may be visa issuance delays if the Consular location is unable to stay operational during the shutdown
